1. Access Data and Hosting

You can visit our website without providing any personal information. Each time our website is accessed, the web server automatically stores a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of access, the amount of data transferred, and the requesting provider (access data), and documents the access. This access data is evaluated exclusively for the purpose of ensuring smooth operation of the site and improving our offering. This serves to protect our legitimate interests in the correct presentation of our offering, which prevail within the context of a balancing of interests pursuant to Art. 6 (1) sentence 1 (f) GDPR.

Hosting

Hosting and delivery of the website are provided by our service providerVercel Inc. (340 S Lemon Ave #4133, Walnut, CA 91789, USA) as a data processor on our behalf. Unless stated otherwise in this privacy policy, all access data as well as all data collected via forms on this website is processed on their servers.

Our service provider is based in and/or uses servers in the USA. The adequacy decision for the USA serves as the basis for the transfer to a third country, provided the service provider is certified accordingly. In addition, the data transfer is based on the European Commission's Standard Contractual Clauses.

2. Data Processing for Contact and Customer Communication

Contact

When you contact us, we collect personal data pursuant to Art. 6 (1) sentence 1 (b) GDPR in order to process your inquiry, provided you voluntarily share this data with us when making contact (e.g. via contact form or email). Required fields are marked as such, because in these cases we absolutely need the data to process your inquiry. Which data is collected can be seen from the respective input forms. After your inquiry has been fully processed, your data will be deleted, unless you have expressly consented to further use of your data pursuant to Art. 6 (1) sentence 1 (a) GDPR, or we reserve the right to further use that is legally permitted and about which we inform you in this policy.

Once your customer inquiry has been fully processed, your data will be restricted from further processing and deleted after the statutory retention periods under tax and commercial law have expired, pursuant to Art. 6 (1) sentence 1 (c) GDPR.

Sending the Contact Form (Web3Forms)

To transmit messages submitted via our contact form, we use the serviceWeb3Forms, operated by Web3Creative. The provider is based in India.

Data processed: The information you enter in the form (name, email address, phone number if applicable, selected topic or service, budget information, and your message) as well as technical metadata such as IP address, timestamp, and referrer information. This data is transmitted to Web3Forms and forwarded to us by email.

Legal basis: Art. 6 (1) sentence 1 (a) GDPR (your consent via the checkbox) as well as Art. 6 (1) sentence 1 (b) GDPR, provided your inquiry is aimed at concluding a contract.

Data processing agreement: A data processing agreement pursuant to Art. 28 GDPR is in place with Web3Creative.

Transfer to third countries: Processing takes place in India as well as, in part, outside the European Union via subprocessors used. There is no adequacy decision by the European Commission for India. The transfer is therefore based on the European Commission's Standard Contractual Clauses pursuant to Implementing Decision (EU) 2021/914, which form part of the data processing agreement.

Subprocessors: Providers for cloud infrastructure, content delivery, and spam/abuse detection are used to provide the service. As part of spam checking, your IP address and email address are transmitted to providers based in the USA. Web3Creative provides a current list of subprocessors on request and via the service.

Retention period: Data submitted via the form is retained by the provider for a period of up to three years and then automatically deleted. Regardless of this, we delete your data after processing has concluded, in accordance with the principles described under item 2.

3. Cookies and Other Technologies

3.1 General Information

This website does not use tracking, analytics, or marketing cookies. There is no evaluation of your usage behavior, and no consent banner is required.

3.2 Fonts

This website exclusively uses locally hosted fonts. No data is transmitted to external providers such as Google Fonts.

4. Social Media

Our Online Presence on Instagram and Facebook (by Meta)

Provided you have given your consent pursuant to Art. 6 (1) sentence 1 (a) GDPR to the respective social media operator, your data is automatically collected and stored for market research and advertising purposes when you visit our profiles on the social media platforms named above, and usage profiles are created using pseudonyms. These may be used, for example, to place advertisements within and outside the platforms that are presumed to match your interests. Cookies are typically used for this purpose. For detailed information on the processing and use of data by the respective social media operator, as well as contact options and your rights and settings options to protect your privacy, please refer to the providers' privacy notices.

Note: This website only contains links to our social media profiles. Simply visiting our website does not transmit any data to the platform operators. Data is only transmitted once you actively click one of these links and visit the respective platform.

Instagram (by Meta) and Facebook (by Meta) are services of Meta Platforms Ireland Ltd., Block J, Serpentine Avenue, Dublin 4, Ireland. Data may be transferred to Meta Platforms, Inc., 1601 Willow Road, Menlo Park, California 94025, USA.

5. Contact Options and Your Rights

5.1 Your Rights

As a data subject, you have the following rights:

  • pursuant to Art. 15 GDPR, the right to request information about your personal data processed by us to the extent specified therein;
  • pursuant to Art. 16 GDPR, the right to request the immediate correction of inaccurate personal data stored by us, or the completion of your personal data;
  • pursuant to Art. 17 GDPR, the right to request the deletion of your personal data stored by us, unless further processing is necessary to exercise the right to freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or to assert, exercise, or defend legal claims;
  • pursuant to Art. 18 GDPR, the right to request the restriction of the processing of your personal data;
  • pursuant to Art. 20 GDPR, the right to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format, or to request its transfer to another controller;
  • pursuant to Art. 77 GDPR, the right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace, or the authority responsible for our registered office.

Right to Object

Where we process personal data as described above to protect legitimate interests that prevail within the context of a balancing of interests, you may object to this processing with effect for the future. If the processing is carried out for direct marketing purposes, you can exercise this right at any time. If the processing is carried out for other purposes, you have a right to object only for reasons arising from your particular situation.

After you exercise your right to object, we will no longer process your personal data for these purposes, unless we can demonstrate compelling legitimate grounds for the processing that outweigh your interests, rights, and freedoms, or if the processing serves to assert, exercise, or defend legal claims.
